Laying the institutional foundation for proactive administration

In August 2019, proactive administration was institutionalized by enacting the ‘Operating Regulations on Proactive Administration’, including the establishment of the Ministry of Personnel Management(->proactive administrationa committee) and the establishment of legal grounds for proactive administration public officials’ benefits in personnel evaluation and exemption from disciplinary action From June 2021, proactive administration public officials’ benefits in personnel evaluation and exemption from disciplinary action are (->encouragement of proactive administraion is) backed by the State Public Officials Act, the Local Public Officials Act, and the General Act on Public Administration.

Support for proactive decision-making

1. Establishment (2019) - Asking for advice from the Proactive Administration Committee (established in each department) and prior consulting to an audit institution (self-auditing institution, the Board of Audit and Inspection of Korea) when it is difficult to carry out proactive administration due to unclear laws 2. Expansion (2020) - Increased the number of members to enhance the expertise of the committee (15 to 45) - Introduced a pool system that organizes the committee with expert members related to meeting agenda - Introduced a procedure to listen to ideas of the stakeholders during deliberation - Established a system providing legal opinions 3. Changes (the first half of 2021) - Established legal grounds for installing and operating the Proactive Administration Committee (the State Public Officials Act, the Local Public Officials Act, and the General Act on Public Administration)

Providing benefits for proactive administration

1. Establishment (2019) - Selecting exemplary public officials per government organization (semiannually) and providing benefit in personnel evaluation were made mandatory - Hosted a contest for best practices of proactive administration (special promotion for those who received the Prime Minister's Commendation or higher) 2. Expansion (2020) - Established an award for persons contributing to proactive administration 3. Changes (the first half of 2021) - Laid legal grounds for providing benefits in personnel evaluation to promote proactive administration

Providing exemption for exemplary proactive administration public officials

1. Establishment (2019) - Exemption from disciplinary action in the disciplinary stage when work is handled following the advice of the Proactive Administration Committee or prior consultation ※ In case of prior consultation, exemption is guaranteed even in the audit stage (Both self-audit, audit by the Board of Audit and Inspection of Korea) 2. Expansion (2020) - Guaranteed exemption from disciplinary actions if work is handled as per the advice from the Proactive Administration Committee - The Proactive Administration Committee is to suggest exemption when auditing is conducted by the Board of Audit and Inspection of Korea. 3. Changes (the first half of 2021) - Laid legal grounds for exemptions of exemplary proactive administration public officials

Protection of exemplary proactive administration public officials

1. Establishment (2019) - Provides litigation support if a public official is sued due to proactive administration 2. Expansion (2020) - Introduced ""Liability Insurance for Public Officials"" (revised to ""Regulations on the Public Welfare of Public Officials"")
